Terms of Service

Welcome to Ciorcal. These Terms of Service ("Terms") govern your access to and use of the Ciorcal mobile application ("App") operated by Ciorcal ("we", "our", or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 17 years of age to use Ciorcal. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account.
• Notify us immediately of any unauthorised access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use the App to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory.
• Impersonate any person or entity, or misrepresent your identity or affiliation.
• Spam, solicit, or send unsolicited messages to other users.
• Upload malicious software, viruses, or harmful code.
• Attempt to gain unauthorised access to the App, other accounts, or related systems.
• Use the App for any commercial purpose without our prior written consent.
• Scrape, harvest, or collect user data without authorisation.
• Manipulate or abuse the Buy Nothing raffle system.

4. User Content

You retain ownership of the content you post on Ciorcal, including posts, photos, messages, event listings, housing listings, and Buy Nothing item listings ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the App.

You are solely responsible for your User Content. We do not endorse any User Content and assume no liability for content posted by users.

5. Community Features

5.1 Events

Ciorcal allows users to create and discover community events. Event organisers are responsible for the accuracy of event details. Ciorcal is not responsible for the conduct, safety, or outcome of any events organised through the App.

5.2 Housing

Housing listings on Ciorcal are provided by community members. We do not verify, endorse, or guarantee any housing listings. Users are responsible for conducting their own due diligence before entering into any housing arrangements.

5.3 Buy Nothing Raffle

The Buy Nothing feature allows users to list items for free and other users to enter a raffle. Winners are selected automatically by the App. All items are given freely with no expectation of payment or exchange. Ciorcal is not responsible for the condition, quality, or delivery of items listed. Users participate at their own risk.

5.4 Messaging

Ciorcal provides messaging features for users to communicate. We do not monitor private messages in real time, but we may review messages if reported for violations of these Terms or our Community Guidelines.

5.5 Rewards

Ciorcal may offer badges, rewards, or recognition for community participation. These rewards have no monetary value and cannot be exchanged, transferred, or redeemed for cash or goods. We reserve the right to modify or discontinue the rewards programme at any time.

6. Moderation and Enforcement

We reserve the right, but are not obligated, to monitor, review, and remove any User Content at our sole discretion. We may suspend or terminate your account if you violate these Terms. We may also report illegal activity to the appropriate authorities.

7. Intellectual Property

The App, including its design, features, branding, logos, and underlying code, is owned by Ciorcal and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.

8. Third-Party Services

The App may integrate with or contain links to third-party services (such as Firebase, Apple, or Google). Your use of such services is governed by their respective terms and privacy policies. We are not responsible for the content, practices, or availability of third-party services.

9. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free. We disclaim all liability for any interactions, transactions, or disputes between users.

10. Limitation of Liability

To the maximum extent permitted by law, Ciorcal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, or goodwill. Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, if any.

11. Indemnification

You agree to indemnify and hold harmless Ciorcal, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the App, your User Content, or your violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

13. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App at our discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of British Columbia.
